HARRISBURG, Pa. (AP) ? Pennsylvania prosecutors said Monday they now believe the alleged locker-room shower assault of a boy by Jerry Sandusky that ultimately led to football coach Joe Paterno‘s firing took place a year earlier than they first claimed.
The attorney general’s office said in a court filing that investigators have concluded the alleged attack took place around Feb. 9, 2001. Previously filed court documents, including a grand jury report issued before the former Penn State assistant coach’s arrest in November, dated it March 1, 2002.
Then-graduate assistant Mike McQueary has said he complained to Paterno of seeing the boy, described in court records as “Victim 2,” in the shower naked with Sandusky.
He testified in December that he believed Sandusky was molesting the boy and “having some type of sexual intercourse with him,” but added he was not “100 percent” certain they were having intercourse because of his vantage point.
Penn State’s trustees have said they fired Paterno as coach partly because of his response to the incident. Paterno reported the matter to administrators Gary Schultz and Tim Curley, which trustees have called “his minimum legal duty” and “a failure of leadership.” Paterno was fired as coach in November. He died in January of lung cancer.
The judge in the case has issued a gag order prohibiting lawyers for both sides from speaking about the case.
Scranton defense lawyer Joseph D’Andrea, who is not involved in the Sandusky case, said the one-year time change may not affect the prosecution, assuming all other relevant facts remain consistent. He said recollections of dates over a 10-12 year time span are naturally imperfect.
“If all the other facts match up to be identical, I think it’s just an error without any harm for the prosecution,” D’Andrea said. “However, if there are other inconsistencies, it gives the defense a reason to create some doubt about the credibility, sincerity, honesty and true recollection of what McQueary had to say.”
Reached by phone, McQueary’s father John McQueary declined comment on his son’s behalf.
The prosecution filing Monday comes ahead of a hearing on Wednesday in Bellefonte regarding defense subpoenas and any remaining disputes over what material must be disclosed to the defense.
Sandusky, 68, awaits a June trial on 52 criminal counts related to alleged sexual abuse of 10 boys over 15 years. Sandusky has denied the allegations against him.
Monday’s filing said only that investigators relied on “specific and authenticated findings” to conclude the shower incident occurred in 2001. Prosecutors have said they don’t know who the boy was.
Sandusky defense attorney Joe Amendola has previously maintained the 2002 date was incorrect.
In a March 25 story, Amendola told The Associated Press that a young man had come forward to him to say he believed he might be the person described as Victim 2 and that Sandusky had not abused him. Amendola said the young man later obtained a lawyer and cut off contact.
Amendola said Sandusky has told him he knew the young man in question but was convinced the date was in 2001, and at that time he had offered to help Curley locate the boy.
Curley, the athletic director now on leave, and Schultz, retired as a university vice president, are fighting allegations they lied to the Sandusky grand jury and failed to properly report suspected child abuse.
Also Monday, Amendola announced that Sandusky will not attend the Wednesday hearing at the Centre County Courthouse in Bellefonte.
Judge John Cleland is expected to address requests to dismiss subpoenas sent to three school districts and two child welfare agencies in central Pennsylvania. A defense subpoena sent to Juniata College is also expected to be discussed.
The state departments of Public Welfare, Corrections and Labor and Industry on Monday filed motions that indicate they have received defense subpoenas, but want Cleland to seal their motions to have them thrown out, to prevent the possible identification of the alleged victims.

Clinton pushes Bangladesh to resolve political unrest
US Secretary of State Hillary Clinton urged Bangladesh on Saturday to pull out of a spiral of political turmoil, saying the impoverished nation’s democratic credentials were at stake.
“We urge all political actors in Bangladesh to work together for the good of the country,” Clinton told reporters following talks in Dhaka with Foreign Minister Dipu Moni.
“In a strong democracy, everybody has to be rowing in the same direction because you’re all in the same boat,” she said. “We want to see Bangladesh succeed.”
Clinton arrived in Bangladesh earlier Saturday for a brief visit shadowed by rallies and strikes over the disappearance of regional opposition figure Ilias Ali in April.
Supporters say that he was seized by security forces. Four people have died in the unrest and rights groups say dozens more have “disappeared” — most of them politicians.
Clinton raised the issue of the disappearances during her talks with Moni and stressed the need for political parties to settle their differences in parliament and not on the streets.
“It’s important that in this country which has such unlimited potential and has proven its ability to sustain the democratic path… that everybody take seriously any disappearance, any violence against activists, any oppression of civil society,” she said at a joint press conference.
She also called for an end to the recent spate of violent strikes saying they “exact a heavy toll, especially on Bangladesh’s poorest and most vulnerable citizens.”
Clinton is the first US secretary of state to visit Bangladesh since Colin Powell in 2003.
In unusually large crowds even for Clinton, thousands of Bangladeshis lined the streets for a glimpse of her motorcade. One well-wisher held a sign, “Heartiest welcome to Forgain (sic) Minister Clinton.”
After the press conference, Clinton held talks with Prime Minister Sheikh Hasina and later signed a joint statement that stressed the two countries’ “shared values” and “respect for human rights and the rule of law.”
The statement sets up a so-called “dialogue on partnership” that will include annual talks.
Later, Clinton was scheduled to meet opposition leader Khaleda Zia.
Sheikh Hasina and Zia have dominated Bangladesh’s politics for decades and their mutual dislike is as intense as it is personal.
Following a rally in the capital last weekend and a series of explosions at a government building complex, police charged and arrested a number of senior figures from the Zia’s Bangladesh Nationalist Party.
Despite the unrest, the United States views Bangladesh as a moderate, democratic Muslim-majority nation that is a US partner in counter-terrorism efforts and the world’s largest contributor to UN peacekeeping.
But one thorny issue Clinton will address involves recent problems for Muhammad Yunus, Bangladesh’s only Nobel peace prize winner and a personal friend of Clinton and her husband Bill.
Yunus was forced out of his ground-breaking micro-credit Grameen bank last year and has since claimed to be the victim of a vendetta that will result in the government seizing his empire of social businesses aimed at alleviating poverty.
Clinton was scheduled to meet Yunus on Sunday.
In Dhaka, the government had talked up Clinton’s visit as an event that would take ties to “a new height”.
Moni said relations had “matured” over the years, but said trade ties could be improved as she pushed for greater access to US markets and lower tariffs for Bangladeshi exports.
Clinton leaves Sunday for India where her visit will coincide with that of a large Iranian trade mission, seeking commercial opportunities to mitigate the impact of US economic sanctions.
Washington has been pressuring India to reduce its oil purchases from Iran in a bid to coax the Islamic republic to abandon its disputed nuclear programme.
India has publicly opposed the US sanctions while quietly diversifying oil sources and cutting shipments from the Persian Gulf nation in the hope, observers say, of being granted a US waiver for remaining Iranian oil imports.

‘Losing yourself’ in a fictional character can affect your real life
ScienceDaily (May 7, 2012) ? When you “lose yourself” inside the world of a fictional character while reading a story, you may actually end up changing your own behavior and thoughts to match that of the character, a new study suggests.
Researchers at Ohio State University examined what happened to people who, while reading a fictional story, found themselves feeling the emotions, thoughts, beliefs and internal responses of one of the characters as if they were their own — a phenomenon the researchers call “experience-taking.”
They found that, in the right situations, experience-taking may lead to real changes, if only temporary, in the lives of readers.
In one experiment, for example, the researchers found that people who strongly identified with a fictional character who overcame obstacles to vote were significantly more likely to vote in a real election several days later.
“Experience-taking can be a powerful way to change our behavior and thoughts in meaningful and beneficial ways,” said Lisa Libby, co-author of the study and assistant professor of psychology at Ohio State University.
There are many ways experience-taking can affect readers.
In another experiment, people who went through this experience-taking process while reading about a character who was revealed to be of a different race or sexual orientation showed more favorable attitudes toward the other group and were less likely to stereotype.
“Experience-taking changes us by allowing us to merge our own lives with those of the characters we read about, which can lead to good outcomes,” said Geoff Kaufman, who led the study as a graduate student at Ohio State. He is now a postdoctoral researcher at the Tiltfactor Laboratory at Dartmouth College.
Their findings appear online in the Journal of Personality and Social Psychology and will be published in a future print edition.
Experience-taking doesn’t happen all the time. It only occurs when people are able, in a sense, to forget about themselves and their own self-concept and self-identity while reading, Kaufman said. In one experiment, for example, the researchers found that most college students were unable to undergo experience-taking if they were reading in a cubicle with a mirror.
“The more you’re reminded of your own personal identity, the less likely you’ll be able to take on a character’s identity,” Kaufman said.
“You have to be able to take yourself out of the picture, and really lose yourself in the book in order to have this authentic experience of taking on a character’s identity.”
In the voting study, 82 undergraduates who were registered and eligible to vote were assigned to read one of four versions of a short story about a student enduring several obstacles on the morning of Election Day (such as car problems, rain, long lines) before ultimately entering the booth to cast a vote. This experiment took place several days before the 2008 November presidential election.
Some versions were written in first person (“I entered the voting booth) while some were written in third person (“Paul entered the voting booth”). In addition, some versions featured a student who attended the same university as the participants, while in other versions, the protagonist in the story attended a different university.
After reading the story, the participants completed a questionnaire that measured their level of experience-taking — how much they adopted the perspective of the character in the story. For example, they were asked to rate how much they agreed with statements like “I found myself feeling what the character in the story was feeling” and “I felt I could get inside the character’s head.”
The results showed that participants who read a story told in first-person, about a student at their own university, had the highest level of experience-taking. And a full 65 percent of these participants reported they voted on Election Day, when they were asked later.
In comparison, only 29 percent of the participants voted if they read the first-person story about a student from a different university.
“When you share a group membership with a character from a story told in first-person voice, you’re much more likely to feel like you’re experiencing his or her life events,” Libby said. “And when you undergo this experience-taking, it can affect your behavior for days afterwards.”
While people are more likely to lose themselves in a character who is similar to themselves, what happens if they don’t learn that a character is not similar until later in a story?
In one experiment, 70 male, heterosexual college students read a story about a day in the life of another student. There were three versions — one in which the character was revealed to be gay early in the story, one in which the student was identified as gay late in the story, and one in which the character was heterosexual.
Results showed that the students who read the story where the character was identified as gay late in the narrative reported higher levels of experience-taking than did those who read the story where the character’s homosexuality was announced early.
“If participants knew early on that the character was not like them — that he was gay — that prevented them from really experience-taking,” Libby said.
“But if they learned late about the character’s homosexuality, they were just as likely to lose themselves in the character as were the people who read about a heterosexual student.”
Even more importantly, the version of the story participants read affected how they thought about gays.
Those who read the gay-late narrative reported significantly more favorable attitudes toward homosexuals after reading the story than did readers of both the gay-early narrative and the heterosexual narrative.
Those who read the gay-late narrative also relied less on stereotypes of homosexuals — they rated the gay character as less feminine and less emotional than did the readers of the gay-early story.
“If people identified with the character before they knew he was gay, if they went through experience-taking, they had more positive views — the readers accepted that this character was like them,” Kaufman said.
Similar results were found in a story where white students read about a black student, who was identified as black early or late in the story.
Libby said experience-taking is different from perspective-taking, where people try to understand what another person is going though in a particular situation — but without losing sight of their own identity.
“Experience-taking is much more immersive — you’ve replaced yourself with the other,” she said.
The key is that experience-taking is spontaneous — you don’t have to direct people to do it, but it happens naturally under the right circumstance.
“Experience-taking can be very powerful because people don’t even realize it is happening to them. It is an unconscious process,” Libby said.
The study was funded by a National Science Foundation Graduate Research Fellowship to Kaufman.
